Home Inspection Contract Agreement 2016
A house inspection performed by Bill Allen Inspections is a limited visual inspection of accessible areas and items of the dwelling and is a subjective report of the condition as of the day of the inspection. Only items listed on the inspection report are inspected. No warranty of the structure, equipment or habitability is expressed or implied.
The Client(s) agrees to obtain and read all manuals and instructions for all appliances and/or amenities before use and be aware of possible hazards. It is agreed that Bill Allen Inspections has no duty to point out potential problems with inspected items nor inspect for quality of workmanship, nor has comment been made regarding latent defects or conditions. No engineering, scientific or environmental test will be performed. Design deficiencies are not within the scope of the inspection. The report does not guarantee dwelling adheres to any building code.
It is agreed that if any portion of this contract is deemed to be unenforceable or invalid, the balance of the contract will remain intact. It is agreed that the inspection report is intended for the sole use of the Clients and is not transferable to other persons.
Client(s) understands that it is highly recommended that a qualified specialist be consulted for further evaluation and repair of items marked on the report as “Deficient” on the inspection report. Client also agrees that this inspection is based on the premise that all houses have problems that are not always detectable, problems that can be concealed or inadvertently overlooked due to human error, therefore Client assumes a risk when purchasing the building(s).
THE CLIENT HAS THE RIGHT TO TERMINATE THIS INSPECTION ANY TIME BEFORE SIGNING THIS CONTRACT.
THE CLIENT AGREES TO RELEASE BILL DURTSCHI, INC. (d.b.a. BILL ALLEN INSPECTIONS, 6007 CARY DR. AUSTIN, TX 78757) AND THE INSPECTOR, BILL DURTSCHI, FROM ANY AND ALL TYPES OR FORM OF LIABILITY AND/OR COMPENSATION FOR ANY REASON WITHIN STATE AND FEDERAL GUILDLINES, ON THIS DAY AND ALL DAYS AFTER.
The Client shall also be aware that any subsequent inspection of the property, including a wood destroying insect inspection, requested either by the client or the client’s agent, and performed by Bill Allen Inspections, shall be accompanied with an additional inspection report and/or addendum to the original inspection report and that such a report and/or addendum shall be covered by the terms of this contract.

ARBITRATION – In the event that any dispute arises by and between client and Bill Allen Inspections whether or not such dispute arises from this agreement, parties agree to submit any dispute between the parties to binding arbitration; the arbitrator shall be mutually agreed upon. All parties involved shall be responsible for their own attorney’s fees, expenses and cost. This inspection, contract and agreement shall be deemed performable in Austin, Travis County, Texas and any venue for the legal proceeding shall be in Travis County, Texas and the decision of the arbitrator shall be final and conclusive.
I/We, (the Client) have read, understand and agree to the above terms.
Changes made to this contract must be mutually agreed upon by both the Client and Inspector.
Follow up inspections requested by the Client(s) will cost $75.00 per hour.
